General Terms and Conditions of Sale

Preamble and Seller Identification Details
These terms and information are provided pursuant to Italian Legislative Decree no. 206/2005 ('Consumer Code') as amended by Legislative Decree no. 26/2023 (implementing EU Directive 2019/2161, 'Omnibus Directive'), and Legislative Decree no. 70/2003 on electronic commerce.

Art. 1 — Scope of Application and Legal Definitions
1.1 These General Terms and Conditions of Sale ('GTC') exclusively govern the offering, placement, and acceptance of purchase orders for custom vinyl decal graphic kits, decals, application tools, and ancillary services concluded remotely via the Website between the Seller and any buyer ('Customer').
1.2 For the purposes of these GTC, statutory definitions under Art. 3 of the Consumer Code apply:
Consumer: any natural person acting for purposes unrelated to trade, business, craft, or professional activity. Professional: any natural or legal person acting in the course of their trade, business, craft, or profession, identified via their VAT registration number. Custom-Made or Personalized Product: any graphic item produced, cut, or printed based on specific color schemes, motorcycle models/years, layouts with rider names, race numbers, logos, or artworks provided or confirmed by the Customer. Standard Product / Accessory: off-the-shelf catalog items without custom design (e.g. application squeegees, cutters, application fluids).
1.3 The applicable GTC are those in force at the time of order placement. The Seller reserves the right to amend them; revisions become effective upon publication on the Website.
Art. 2 — Purchase Process and Conclusion of Electronic Contract
2.1 Pursuant to Art. 1326 et seq. of the Italian Civil Code and Art. 12 of Legislative Decree 70/2003, the remote sales contract is concluded when the Customer's order reaches the Seller's system and the Seller receives immediate payment authorization from authorized payment gateways.
2.2 Prior to submitting the order, the Customer reviews the order checkout summary and must express explicit contractual acceptance by checking the mandatory, un-prechecked checkbox accepting these GTC and the exclusion of the right of withdrawal for custom-made goods.
2.3 Upon conclusion, the Seller promptly sends an order confirmation email to the address provided by the Customer, including: Seller details, order number, product summary, total price, currency, selected payment method, and a link/reference to these GTC.
2.4 Condition of Sale for Standard Products: standard accessories on the Website (e.g. wrapping squeegees) are sold exclusively as add-on items and cannot be purchased separately without at least one graphic kit in the order.
Art. 3 — Pricing, Tax Scheme, and Customs Duties
3.1 All prices of Products, finishes, and ancillary services on the Website are indicated in Euros (€).
3.2 Flat-Rate Tax Scheme (Regime Forfettario): the Seller operates under the special flat-rate tax regime pursuant to Art. 1, paragraphs 54-89 of Italian Law 190/2014 as amended. Sales on the Website do not include or charge VAT. The amount shown at checkout matches the final total due.
3.3 Prices do not include local taxes, import duties, or customs clearance fees imposed by non-EU countries. Such costs remain strictly the responsibility of the recipient/buyer.
Art. 4 — Digital Proof Validation Workflow (Binding Proof)
4.1 Due to the technical and custom nature of graphic kits, each order includes the preliminary preparation of a digital vector mockup/proof sent to the Customer via account area, email, or WhatsApp.
4.2 Permitted Revisions: the Customer is entitled to request adjustments to the initial design for up to two (2) complimentary review rounds. Further revisions or complete design overhauls are subject to separate hourly billing rates.
4.3 Binding Approval: formal validation occurs by clicking 'Approve Proof' or by explicit written confirmation. Upon approval: (1) layout becomes final, irrevocable, and locked; (2) the order enters immediate printing, lamination, and cutting production; (3) typos, race numbers, rider names, or sponsor placements cannot be disputed; (4) any cancellation or refund request for change of mind is strictly voided.
Art. 5 — Intellectual Property, Third-Party Trademarks, and Indemnity
5.1 Any Customer requesting the inclusion of registered trademarks, sponsors, logos, or protected graphics warrants and represents, under their sole civil and criminal responsibility, that they hold valid ownership or official written authorizations/licenses to reproduce such marks pursuant to applicable intellectual property and copyright laws.
5.2 The Customer agrees to hold the Seller fully harmless and indemnified against any claims, damage awards, legal fees, or sanctions brought forward by third parties or regulatory authorities regarding the use, printing, and manufacturing of customer-supplied logos.
5.3 The Seller reserves the right to reject graphics that constitute clear infringement or counterfeiting.
Art. 6 — Payment Methods and Transaction Security
6.1 Payments can be executed exclusively through integrated electronic payment gateways: debit/credit cards, Apple Pay, and Google Pay processed via Stripe Payments Europe, Ltd.; PayPal balance or 'Pay in 3 installments' via PayPal (Europe) S.à r.l. et Cie, S.C.A.
6.2 Transactions comply with EU Directive 2015/2366 (PSD2) and Strong Customer Authentication (SCA) protocols. No banking details, card numbers, or security codes are handled or stored on the Seller's servers.
Art. 7 — Shipping, Manufacturing Timelines, and Risk Transfer
7.1 Shipments are handled via express couriers across Italy and European Union member states.
7.2 Delivery Costs: Italy, free standard shipping on all complete graphic kits. European Union / International, flat rate calculated and clearly displayed during checkout prior to payment.
7.3 Manufacturing and Delivery Timeframes: lead times run exclusively from the formal proof approval (Art. 4.3). Standard production: digital file preparation, high-tack vinyl printing, thick crystall lamination, and contour plotting take approximately 7-10 business days. Rush Option: when selected, production and dispatch are accelerated to 48-72 business hours from approval.
7.4 Transfer of Risk: for Consumer purchases, risk of loss or damage transfers to the Consumer once they, or a designated third party other than the carrier, takes physical possession of the parcels.
7.5 Transit Damage and Notice: upon delivery, the Customer must inspect package condition. Any damage, tearing, or crushing must be accepted under specific reservation ('accepted with reservations') on the courier slip and reported with photos to the Seller within 30 calendar days from delivery to initiate a claim, refund, or reprint.
Art. 8 — Right of Withdrawal
8.1 Statutory Exclusion for Custom-Made Goods: pursuant to Art. 59(1)(c) of the Consumer Code and Art. 16(c) of Directive 2011/83/EU, the 14-day statutory right of withdrawal or return for change of mind is excluded for goods made to custom specifications or clearly personalized. All graphic kits manufactured per motorcycle model, year, custom colorway, names, numbers, or sponsors fall under this statutory exclusion; following proof approval (Art. 4) and production kickoff, no withdrawal or refund is permitted.
8.2 Withdrawal for Standard Products / Add-On Accessories Only: for non-customized standard catalog tools purchased as add-ons, Consumers may withdraw within 14 calendar days from physical receipt. Notice: written declaration sent to info@17wheel.it. Integrity: accessories must be returned intact, in unopened original packaging, unused, and undamaged. Costs: return postage is borne by the Customer. Upon receipt and inspection, the Seller refunds the accessory amount within 14 days.
Art. 9 — Crash Replacement Post-Sale Program
9.1 For all graphic kits previously manufactured and supplied by 17Wheel, the Seller offers Customers access to the 'Crash Replacement' program.
9.2 Terms: flat fee of €49.00, including reprint, heavy-duty vinyl material, and courier delivery. Coverage: reprint and replacement of a single damaged fairing piece or sticker element (e.g. front number plate, radiator shroud, or fender) damaged due to track crashes, falls, or riding impacts after installation. Validity: this service may be requested up to 18 months from original purchase date. Claim: Customer submits original order receipt/order ID along with a clear photo of the damaged piece.
Art. 10 — Production Defects, Conformity Claims, and Refunds
10.1 Reporting Production or Shipping Defects within 30 Days: if the delivered item exhibits evident manufacturing defects, vendor-side dimensional cutting flaws relative to the approved template, material failure, or transit damages, the Customer must submit a formal complaint with photos/video to info@17wheel.it or WhatsApp within thirty (30) calendar days of receiving the order to be eligible for a free reprint/replacement or refund.
10.2 Remedies: once the defect or transit damage is confirmed within the 30-day window, the Seller will prioritize an expedited free reprint and reshipment of the affected item, or issue a full or partial refund where agreed.
10.3 Exclusions: refunds or free reprints do not cover damage caused by incorrect installation (e.g. air bubbles, stretching, excessive heat application), poor plastic cleaning/degreasing, or post-installation riding crashes (which are covered exclusively by the paid Crash Replacement program valid for 18 months under Art. 9).
10.4 B2B Professional Customers: for purchases made under a VAT ID, apparent defects must be notified in writing within eight (8) days of receipt.

Art. 12 — Applicable Law, Jurisdiction, and Dispute Resolution
12.1 Applicable Law: the sales contract is governed by Italian law, without prejudice to mandatory protective provisions of the Consumer's habitual country of residence.
12.2 Consumer Court Jurisdiction: disputes with Consumers fall under the mandatory jurisdiction of the Consumer's place of residence or domicile (within Italy).
12.3 Business Jurisdiction (B2B): for disputes with commercial entities and VAT holders, the Court of Piacenza (Italy) has exclusive jurisdiction.
12.4 Alternative Dispute Resolution (ODR): European Consumers may access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
